BY ORDER OF THE FEDERAL COURT OF AUSTRALIA

 

From at least August 2015 to June 2016, Elusion Australia Limited represented to consumers on our website that our e-cigarette products:

  • did not contain harmful chemicals, cancer-causing chemicals or carcinogens;
  • did not contain harmful chemicals, cancer-causing chemicals or carcinogens found in traditional tobacco cigarettes; and
  • did not contain any of the chemicals found in traditional tobacco cigarettes

In fact, when our e-cigarette products are used, the vapour produced for inhalation does contain harmful chemicals, cancer-causing chemicals or carcinogens, including Acetaldehyde, Acrolein and Formaldehyde.  Those chemicals are also found in tobacco cigarette smoke.

Following Federal Court proceedings taken by the Australian Competition and Consumer Commission (ACCC), the Court has found that the representations which we made on our website were false, misleading or deceptive in contravention of the Australian Consumer Law (ACL).

As part of its orders, the Court also restrained Elusion and its director Mr Burden from engaging in similar conduct, imposed pecuniary penalties of $40,000 on Elusion and $15,000 on Mr Burden, and also required Elusion and Mr Burden to pay a contribution of $5,000  to the ACCC’s costs of the proceeding.

 

This corrective notice has been paid for and placed by Elusion Australia Limited pursuant to an order of the Federal Court of Australia in an action commenced by the Australian Competition and Consumer Commission.
